I wanted to provide you with an update regarding Road Safety Issues, which people around your area have highlighted as an issue of concern on the priority survey. Drivers who use their vehicles in an anti-social manner could now have them seized immediately under strengthened police powers.
Changes to Section 59 of the Police Reform Act thanks to the Crime and Policing Act 2026, which came into force on 22nd July 2026, mean officers no longer need to issue a warning before taking enforcement action against anti-social driving.
The new legislation allows police to seize a vehicle at the first incident where it is being driven carelessly, inconsiderately, at excessive speed, or in a way that causes annoyance to other road users.
Previously, drivers received a warning which remained in place for 12 months. Their vehicle could only be seized if they were involved in a further anti-social driving incident during that period.
The updated law removes that requirement, giving officers stronger powers to prevent dangerous behaviour from continuing and helping to keep communities safe. However, officers retain discretion in each case, meaning some drivers will still receive a 12-month warning.
Police officers need only a reasonable belief that the vehicle was being driven in an anti-social manner, and when it comes to seizing a vehicle, it can be taken straight off your driveway.
This was successfully used earlier this month when several calls were made to Nottinghamshire Police in relation to a vehicle driving dangerously and in an anti-social manner. The vehicle was located a short while later back at it's home address where it was seized from the owner. This driver is now being investigated for driving without due care and attention.
When the police recover a vehicle under Section 59 of the Police Reform Act, you will endure the cost for the recovery as well as storage fees which increase daily. After 7 days, if you have not collected your vehicle from the recovery agents then it is liable for destruction.
There will be ongoing patrols around the Victoria Retail Park and Colwick Loop road where there are the most reports, so remember this if you ever feel like you want to drive in a manner which is likely to cause, alarm, distress or annoyance to members of the public. If you are also caught doing this within the Victoria Retail Park and / or the Colwick Loop Road you will also receive a fine from the council for breaching the Public Space Protection order.
The police will be taking a zero tolerance approach if you are caught.
