Today we received several reports of off‑road motorbikes being ridden on common land in the Hemford and Stapley area in an anti‑social and unlawful manner. Officers attended, but the individuals had left prior to our arrival.
Riding a motorbike on common land without lawful authority is a criminal offence. Anyone found riding without insurance or in an area where motor vehicles are not permitted will have their bike seized and will be prosecuted.
Relevant legislation includes:
Road Traffic Act 1988, Section 34 – prohibits driving mechanically propelled vehicles on common land without lawful authority.
Law of Property Act 1925, Section 193 – prohibits driving vehicles on certain urban commons without permission.
Criminal Justice Act 1967 (Schedule 3) – sets penalties for offences on common land.
Vehicular Access Regulations 2002 – outlines the legal process for obtaining vehicular access rights across common land.
