Malvern man served with warning for causing ASB


A 40 year old Malvern man has today been served Community Protection Warning (CPW) In accordance with Section 43 of the Anti-Social Behaviour Crime and Policing Act 2014 due to the man's detrimental behaviour having a negative impact on members of the public his behaviour is considered to be unreasonable. 

The CPW was served by PC Prew of Malvern Safer Neighbourhood Team.

The male has shown an unwanted presence at Great Malvern Cemetery and adjoining chapel in Madresfield Road, Malvern, playing guitar in the graveyard and also seen in possession of drug paraphernalia, causing alarm and distress for staff and members of the public attending the graveyard, including young children. 

The man must refrain from behaving in this way when attending the graveyard and only attend the graveyard for the purpose of visiting graves.

CPW will be reviewed within 12 months from the date of issue. The conduct the man has displayed must stop. If the behaviour continues or the man fails to comply with the CPW the man will be issued with a CPW.

- Failure to comply with a CPN is an offence which may result in a fixed penalty notice (£100).

- The man can also be arrested.

- If the man is are convicted of an offence of failing to comply with a CPN he will be liable to a fine not exceeding level 4 on the standard scale currently £2,500 for an individual and an unlimited fine in the case of business or organisation.

- The court may make whatever order the court thinks appropriate.
